RESIDENCE AUTHORIZATIONS DUE TO EXCEPTIONAL CIRCUMSTANCES

FAMILY ROOTING 

 A residence permit may be granted for reasons of family roots when the following requirements are met: 

a) In the case of the father or mother of a minor of Spanish nationality, provided that the requesting parent is responsible for the minor and lives with the minor or is aware of the parent-child obligations with respect to the minor. 

b) When they are children of a father or mother who had originally been Spanish. 

  Required documentation 

• Application form in official model (EX-10) in duplicate, duly completed and signed by the foreigner. 
• Complete copy of the passport, travel document or registration card valid for at least four months. 
• Criminal record certificate issued by the Authorities of the country or countries in which you have resided during the last five years prior to entering Spain.
• Documentation proving family ties and nationality, which will be: 
  • In the event of being the father or mother of a minor of Spanish nationality :
    • Birth certificate of the minor of Spanish nationality stating the family relationship and the Spanish nationality of said minor. 
  • In the event of being the child of a father or mother originally Spanish: 
    • Birth certificate of the applicant. 
    • Birth certificate of the originally Spanish father or mother or certificate from the Civil Registry that certifies said condition. 

Procedure 

Subject entitled to submit the application: the foreigner personally, or his legal representative in the event of being a minor or incapable. In case of electronic presentation, the professional adhered to the corresponding collaboration agreement for carrying out administrative procedures in matters of immigration.

Place of presentation: Immigration Office of the province in which the foreigner has established domicile. The office to which the procedure corresponds can be consulted at: Immigration Offices Spain.

Temporary residence fee due to exceptional circumstances: it will be accrued at the time of admission for processing of the application, and must be paid within ten business days, it is: 

• Model 790 code 052, section 2.5 “Temporary residence authorization due to exceptional circumstances”: to be paid by the foreigner.

Application resolution period: three months from the day following the date on which it was entered in the registry of the competent body for processing. Once this period has elapsed without the Administration having carried out the notification, it may be understood that the request has been rejected due to administrative silence.   

• The granting of the residence authorization of five years duration enables you to work as an employee or self-employed person:
  • When it comes to father or mother, or guardian of a minor of Spanish nationality or is a person who provides support to a Spanish person with a disability.
  • When it comes to the spouse or accredited common-law partner of a citizen of Spanish nationality, dependent parent over 65 years of age or under 65 years of age, dependent descendant under 21 years of age or over 21 years of age, of a citizen of Spanish nationality, or of his or her spouse or de facto couple.
• A one-year residence authorization will be granted that enables you to work as an employee and self-employed person, at the end of which it may be modified to a residence and work authorization, or request an annual extension of this authorization:
  • In the case of children of a father or mother who had originally been Spanish

Within a period of one month from the notification of the granting of the residence authorization due to exceptional circumstances, the foreigner must personally request the Foreign Identity Card, at the Immigration Office or Police Station of the province where the authorization has been processed. .
