Return Authorization

This is to authorize the departure and subsequent return to the national territory of a foreigner whose residence or stay authorization is in the renewal period.

ASSUMPTIONS

1. 1. Be the holder of a residence or stay authorization and have initiated the procedures to renew or extend the authorization that enables you to remain in Spain within the legal period.
   2. Be the holder of a valid foreign identity card and have submitted a request for a duplicate card due to theft, loss, destruction or disuse.
   3. Prove that the trip responds to a situation of necessity and exceptional reasons exist and have the initial authorization of residence or stay resolved favorably and have the issuance of the foreign identity card in process.

LIMITATIONS

A return authorization may not be granted to foreigners who are subject to a prohibition on leaving Spain or a limitation on their freedom of movement agreed by the Judicial Authority on a precautionary basis or in an extradition process, or as a consequence of a final ruling. .

REQUIRED DOCUMENTATION

• • Official model application form (EX 13) in duplicate. duly completed and signed by the foreigner.
  • Copy of the complete passport or registration card and valid travel document.
  • Copy of the application for renewal or extension of the authorization or foreigner's identity card, or receipt accrediting its presentation.
  • In case 3. (having been granted initial residence or stay authorization and having a foreigner's identity card in process): documentation proving that the trip responds to a situation of need and exceptional circumstances occur.

PROCEDURE

• • The subject authorized to submit the application: the foreigner personally, or by representation.
  • place of presentation: any public record addressed to the Immigration Office or the Police Station corresponding to the province in which the foreigner has his/her domicile. (Address information, telephone numbers and public service hours of the Immigration Office)
  • Return authorization processing fees: must always be paid prior to the issuance of the return authorization. They will be accrued at the time the application is accepted for processing, and must be paid within ten business days, they are:

The delivery of the return authorization will always be made to the foreign citizen who is the recipient of the document, except in two cases:

• • minority or disability of the foreigner in which the return authorization may be collected by a legal representative.
  • presence abroad of a proven impossibility of personal appearance (due to illness or temporary physical impediment accredited by a medical certificate or hospital report signed by a registered doctor); In this case, a notarial power of representation may be used.
  • The residence authorization will be valid for no more than 90 days counted:
    • If the residence or stay authorization is not in the renewal period, from the date of granting.
    • If the residence or stay authorization is in the renewal period:
      • from the expiration date of the authorization, if requested before it expires.
      • from the date of granting, if requested after the expiration of the authorization.
  • The return authorization may be used for all departures and subsequent return required during the validity of the authorization.
